I. Participant Acknowledgment and Agreement
By signing this document, the participant (hereinafter "Participant") acknowledges and agrees to the following:
1. Understanding of Risks
The Participant understands and voluntarily assumes all risks associated with participating in water sports activities offered by Fun Beach Water Sports (hereinafter "FBWS"), including, but not limited to, the risks of injury, death, property damage, and loss. These risks may be caused by the Participant’s own actions, the actions of others, or unforeseen circumstances.
2. Physical Fitness and Health
The Participant represents and warrants that they are in good physical condition and have no medical conditions, allergies, disabilities, or are not under the influence of alcohol or drugs that would prevent them from safely participating in the activity. If there are any doubts, consult a physician before participating.
Strict Prohibition on Alcohol and Drugs:
Participation in any water sports activity while under the influence of alcohol or drugs is strictly prohibited. Any violation of this rule will result in immediate disqualification from the activity, and no refunds will be provided.
3. Equipment Usage
The Participant agrees to use all provided equipment responsibly and only in the designated areas as instructed by FBWS staff. The Participant is responsible for all damages to equipment caused by their misuse, negligence, or recklessness, with a minimum damage charge of 2000 DHS. Before leaving, the Participant must inspect the equipment and notify staff of any pre-existing damage.
4. Speed Restrictions
The Participant agrees to adhere to all speed restrictions, especially in designated areas near the marina.
5. Minimum Age
The minimum age for all activities is 16 years. Guests under the age of 16 are not permitted to participate, in line with company policy.
6. Liability Waiver
The Participant agrees to release, indemnify, and hold harmless FBWS, its employees, agents, and affiliates from any and all claims, liabilities, damages, losses, costs, or expenses arising out of or in connection with the Participant’s participation in water sports activities, except in cases of gross negligence or willful misconduct by FBWS.
7. Rules and Regulations
The Participant agrees to abide by all rules and regulations set forth by FBWS.
8. Following Guide/Instructor’s Instructions
The Participant must follow all instructions given by the guide or instructor at all times. Failure to comply may result in the termination of the activity without a refund.
9. Governing Law
This agreement shall be governed by and construed in accordance with the laws of the Federal Government of the UAE.
II. Damage Responsibility
Any damage to equipment beyond normal wear and tear will be the responsibility of the Participant. A minimum charge of 2000 DHS will apply for any damage sustained.
III. Pre-Participation Checklist
Before beginning any activity, please ensure that:
- You have read and understood this disclaimer.
- You are physically fit and prepared for the activity.
- You have received and understood the safety instructions from FBWS staff.
- You are wearing the appropriate safety gear (life jacket, etc.).
IV. Media Release (Optional)
By signing below, I give permission for Fun Beach Water Sports to use images and footage of my participation in activities for promotional and social media purposes.
